Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the OzLuckyDraw platform operated by OzLuckyDraw Pty Ltd (ABN 00 000 000 000). By creating an account or using our services, you agree to be bound by these Terms.

1. Definitions

  • "Platform" means the OzLuckyDraw website, mobile applications, and all related services.
  • "Account" means your registered user account on the Platform.
  • "Ticket" means a digital lottery entry purchased through the Platform.
  • "Draw" means the random number generation event that determines winning numbers.
  • "Prize" means any winnings awarded as a result of a Draw.

2. Eligibility

  • You must be at least 18 years of age.
  • You must be a resident of Australia or physically located within Australia at the time of purchase.
  • You must not be self-excluded from gambling services.
  • You may only hold one (1) Account. Duplicate accounts will be closed and balances forfeited.
  • We reserve the right to verify your identity and age at any time. Failure to provide satisfactory identification may result in account suspension.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your Account is your responsibility. You must notify us immediately of any unauthorised access.

4. Ticket Purchases

  • All prices are displayed and charged in Australian Dollars (AUD) and are inclusive of GST where applicable.
  • A Ticket is considered purchased only after we have confirmed receipt of payment and issued a digital ticket with a unique code.
  • Tickets cannot be cancelled, exchanged, or transferred after purchase.
  • We reserve the right to limit the number of Tickets purchased per Account per Draw.

5. Draws and Results

  • Draws are conducted using a certified Random Number Generator (RNG) independently audited for fairness.
  • Draw results are published on the Platform immediately following completion of the Draw.
  • In the event of a technical failure during a Draw, the Draw may be declared void and all ticket purchases refunded.
  • Our determination of Draw results is final and binding.

6. Prizes and Payouts

  • Prizes are credited to your Account balance within 24 hours of the Draw.
  • Prize amounts are determined by the published prize tier structure for each Draw.
  • Withdrawals are processed within 1–3 business days via your nominated payment method.
  • Withdrawals over $1,000 AUD require identity verification in accordance with our AML/KYC Policy.
  • All prizes are subject to applicable Australian tax laws. We do not withhold tax; it is your responsibility to declare winnings to the ATO.
  • Unclaimed prizes expire 12 months after the Draw date.

7. Bonuses and Promotions

  • Promotional bonuses are subject to specific terms disclosed at the time of the offer.
  • Bonus funds cannot be withdrawn directly and must be used for Ticket purchases.
  • We reserve the right to modify, suspend, or cancel any promotion without prior notice.
  • Abuse of promotions (including creating multiple accounts) will result in forfeiture of bonuses and possible account closure.

8. Responsible Gambling

We are committed to responsible gambling. You agree to use our responsible gambling tools, including deposit limits, loss limits, session time reminders, and self-exclusion. Full details are available in our Responsible Gambling Policy.

9. Prohibited Conduct

You must not:

  • Use the Platform for any unlawful purpose
  • Attempt to manipulate draws, exploit bugs, or use automated software
  • Use the Platform for money laundering or terrorism financing
  • Provide false or misleading information
  • Allow any person under 18 to access your Account
  • Circumvent or attempt to circumvent responsible gambling controls

10. Account Suspension and Termination

We may suspend or terminate your Account at our discretion if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or where required by law. Upon termination, any remaining genuine balance (excluding bonus funds) will be returned to you.

11. Intellectual Property

All content, trademarks, logos, software, and design elements on the Platform are owned by or licensed to OzLuckyDraw Pty Ltd. You may not reproduce, distribute, or create derivative works without our written consent.

12. Limitation of Liability

To the maximum extent permitted by law, OzLuckyDraw shall not be liable for any indirect, incidental, special, or consequential damages. Our total aggregate liability for any claim shall not exceed the amount you paid in Ticket purchases during the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

13. Dispute Resolution

Any dispute shall first be referred to our internal complaints process. If unresolved within 30 days, disputes may be escalated to the relevant state or territory gambling regulator. These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

14. Amendments

We may amend these Terms at any time. Material changes will be notified via email at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
